Trial at Port Elizabeth: GRAHAM v SCORGIE
At the Circuit Court held in Port Elizabeth on Thursday week a case of much interest to the mercantile community was heard. The defendant was the captain of the Shepherdess, recently arrived from London, and the case involved the question as to the Captain’s liability to be answerable for the value of a cask of brandy that had leaked out on board the vessel. The question arose how did this leakage originate? Was it from bad stowage, or by theft, or was it owing to any cause over which the Captain had no control? After carefully examining all the evidence, the learned judge came to the conclusion that the leakage arose from the warping of the cask, and decided the matter in favor of the defendant with costs.

DISCIPLINE OF THE DUTCH REFORMED CHURCH
To the Editor of the SAC Advertiser and Cape Town Mail:
Sir, Can you or any of your correspondents inform me and your readers whether what I have been informed be, or not be, true; namely that it is contrary to the discipline of the “Hollandische Gereformeerde Kerk” in Holland and in this Colony, to have three members of one family, as Parochial Ministers, in one Presbytery? And whether the reason of this disciplinary rule is not this, viz: to prevent one family being able to control all other members of Presbytery, and so to carry all questions by their votes?
The Rev Andrew MURRAY Senr is Predikant of Graaff-Reinet; his son, Rev John MURRAY, is Predikant of Burghersdorp; his son, Rev William MURRAY, is Predikant of Middelburg; his son Charles is about to be ordained, and is said to intend to try to get the new town Hoop-stad (Hope Town) at Duivenaar’s Fontein; (also Rev A LOUW, Predikant of Sannah’s Poort, is about to marry, it is said, Rev Andrew MURRAY Senr’s daughter); and his son, Rev Andrew MURRAY Junr, is Predikant of Bloem Fontein. If, in one generation, five of one family, or six, may thus unite votes; may they not, in the second or third generation, swamp the whole Synod? and absorb its salaries, fees and offices?

MURDER
On Wednesday about midday a report reached Port Elizabeth that a man named Joseph RANDAL, a market gardener, residing in the Banken’s River Valley, had shot his wife dead. Field-cornet TEE, the Clerk of the Peace, the District Surgeon and the Police were soon on the spot, and the accused (who had been secured by a young man named CHERY) was handed over to the custody of the latter. From a statement made by one of the children of the accused, it appears that seeing his father returning home over the bridge, rather tipsy, he followed him, but that his father being in advance entered the house first. Before the boy could reach the dwelling he heard the report of a gun, and immediately after he met his father coming out of the house, who said he had shot his (the boy’s) mother and that he would also shoot himself. On entering the house, the body of the unfortunate deceased was discovered bathed in blood, life being quite extinct. The deceased was 47 years of age and leaves six young children quite unprovided for.

Gerrit Ewoud OVERBEEK Esq, one of the oldest inhabitants of Cape Town, died on Tuesday last at the residence of his son-in-law, J.H. REDELINGHUYS Esq, at Green Point. The venerable gentleman had attained his 88th year. Mr. OVERBEEK was born in Ceylon, and during the early part of his life was at sea. He afterwards became a resident of the Cape, where he filled several public capacities, enjoying the universal esteem of the community. His last office on the civil service was that of a member of the late Orphan Chamber, for which he received a pension of £75 per annum. Almost to the latest period of his life he remained in the enjoyment of good health.
